This patience has limits, though. “When that has been attempted, and the client is still unsatisfied with the answers they have received, that is when they know it may be time to switch. If your questions are not being answered, if you are unable to get in touch with your attorney, or if you are unable to get regular updates, I think that always means it is time to at least investigate switching.”
Red Flags That Should Not Be Ignored
According to the Texas State Law Library, clients who are struggling to get a response from their attorney have legal options and resources available to help resolve those disputes. Beyond communication breakdowns, Chaile identifies the following behaviors as clear indicators that your representation may need a second look:
- Defensiveness or aggression: Refusing to answer questions or responding with hostility to reasonable concerns
- Pressure to settle: Pushing you to accept a settlement or agree to terms you are not comfortable with
- Unsolicited contact: Being approached directly by an attorney before you ever sought their help
- Unusually high fees: A proposed rate that feels significantly higher than what others have quoted
Attorneys who operate with integrity do not engage in any of these behaviors. On the issue of unsolicited outreach, Chaile is unequivocal: “Nobody should be contacting you prior to 30 days, by phone, by mail, by email, or by social media. It is also worth understanding that many attorney-client breakdowns trace back to unreasonable expectations set from the very beginning of the relationship. “One of the biggest pitfalls I see with attorneys is not setting reasonable expectations from the start,” Chaile explains. “If an attorney tells a client they have a $10 million case when the reality is that statutory limits may cap the recovery at $250,000, that creates an unreasonable expectation from day one. It might be too late to completely change course in certain situations, but it is never too late to get a second opinion.”
