After a car accident, your head can be spinning—and not just from the impact. Between medical bills piling up, dealing with pain and loss of work, and the stress of a damaged vehicle, the last thing you want to hear is someone telling you that you can’t get help because you were “partly at fault.”
I recently sat down for an interview with HelloNation to clear the air on this very topic. If you’ve been wondering, “If I was partly at fault in a Texas car wreck, can I still get compensation?”—the answer might be more encouraging than you think.
The “51 Percent Rule”: Texas-Sized Fairness
In our great state, we follow a legal principle called modified comparative fault, or what folks in the legal world often call the “51 percent rule”.
Here is the simple breakdown: In Texas, you can still recover damages for your injuries if you are not more than 50 percent responsible for the accident. If a jury or an insurance adjuster decides you were 51 percent at fault (or more), then you’re barred from collecting compensation. But if you’re at that 50 percent mark or lower, you still have a seat at the table.
How Does it Work in Dollars and Cents?
Think of it like a sliding scale. If you are awarded compensation, the total amount is reduced by your percentage of fault.
For example, let’s say you were in a wreck at an intersection here in Abilene. Maybe the other driver ran a red light, but you were going a few miles over the speed limit. If a jury finds the other driver was 80 percent responsible and you were 20 percent responsible, your compensation would be reduced by that 20 percent. If your total damages (medical bills, lost wages, etc.) totaled $100,000, you would still walk away with $80,000.
Don’t Take the Blame Too Fast
I see it all the time—good, honest folks in West Texas who are quick to apologize at the scene of an accident. Maybe you feel guilty because you were changing the radio station or looking for a turnoff. But here’s the thing: insurance companies are experts at shifting the blame. They want to push your fault percentage as high as possible so they can pay you the least possible.
Assigning fault isn’t just about a “gut feeling.” It involves a deep dive into:
- Police reports
- Witness accounts and scene photographs
- Expert opinions on speed and impact
Even if you think you played a role in the crash, the other driver’s actions—like texting or failing to yield—might actually be the primary cause. That is why it’s so important to have a local legal advocate who knows how to protect your rights.
Why “Hometown” Representation Matters
At The Law Firm of Chaile Allen, we have deep West Texas roots. We know these roads, and we know our neighbors. When we take on a shared fault case, we aren’t just looking at numbers on a page; we’re looking at how this injury affects your daily life, your family, and your future.
Whether you’re dealing with medical bills, lost wages, or the “invisible” trauma of a serious wreck, we fight to make sure the final compensation reflects the actual roles played in the crash.
Take the Next Step
Don’t let an insurance company tell you that you’re out of luck just because you weren’t “perfect” behind the wheel. The 51 percent rule is there to provide a path to recovery, and I’m here to help you walk it.
